Terms and Conditions (Beta)
1. Introduction
Welcome to Capsule Board. Capsule Board is a beta-stage platform for creating, storing, and transferring digital capsules. By accessing or using the service, you agree to these Terms and Conditions. If you do not agree, do not use the service.
2. Account Creation and Management
Eligibility: You must be at least 17 years old to use Capsule Board. Account Registration: You must register using a valid email address and password or Sign in with Apple. You are responsible for safeguarding your account credentials and all activity under your account. Capsule Wallet: Upon registration, you may create or import an Ethereum-compatible wallet. You are solely responsible for securely storing your private keys and mnemonic phrase. Capsule Board cannot recover lost keys.
3. Capsule Creation and Minting
Capsule Definition: Creating a capsule constitutes the creation of a unique digital record. For avoidance of doubt, capsule creation is treated as a minting-like action within the system, regardless of whether it is recorded on a public blockchain. Irreversibility: Once created, certain capsule attributes may be irreversible. You acknowledge and accept this risk.
4. Points System (Beta)
Points Nature: Points are non-refundable, non-transferable platform credits with no cash value. Points do not constitute currency, stored value, securities, or financial instruments. Earning and Purchase: Points may be granted for free during beta testing or purchased as part of paid plans. Valuation Display: Point pricing may be displayed for convenience (e.g., $1 equals a certain number of points), but this does not imply redeemability for cash. Usage: Points may be required for actions such as capsule creation, transfers, or future premium features. Adjustments: Capsule Board may modify point pricing, grants, limits, or required amounts at any time during beta.
5. Free Users and Transfers
Free Tier Access: Free users may create and transfer capsules subject to usage limits. Transfer Costs: Transfers may consume points or be limited in volume for free users. Anti-Abuse Controls: Capsule Board may impose throttling, caps, or restrictions to prevent spam, fraud, or abuse.
6. Subscriptions and Paid Features
Subscription Service: Certain features may be offered via subscription or one-time purchases. Pricing shown during beta is introductory and may change. No Guarantee: Paid features are provided on an as-is basis during beta and may be modified or discontinued.
7. Marketplace (Future Feature)
User-to-User Transactions: Capsule Board may introduce a marketplace allowing users to transact directly with each other. Role of Capsule Board: Capsule Board acts solely as a platform provider and is not a party to transactions between users. Payments: Future marketplace transactions may involve real-world currency or third-party payment providers. Compliance: Additional terms, KYC, or transaction limits may apply if and when a marketplace is launched.
8. Intellectual Property
User Content: You retain ownership of content you create. By using the service, you grant Capsule Board a limited license to host, display, and transmit such content solely to operate the platform. Platform IP: Capsule Board retains all rights to its software, design, trademarks, and system architecture.
9. Prohibited Conduct
You agree not to use the service for unlawful activities, fraud, harassment, intellectual property infringement, or attempts to exploit or reverse-engineer the system.
10. Beta Disclaimer
Experimental Service: Capsule Board is provided on a beta, experimental basis. No Warranties: The service is provided "as is" without warranties of any kind. Data Loss Risk: You acknowledge the risk of data loss, feature changes, or service interruption.
11. Dispute Resolution
User Responsibility: Capsule Board is not responsible for disputes between users. Governing Law: These terms are governed by the laws of the applicable jurisdiction, to be specified in a future revision.
12. Compliance and Legal Requirements
KYC: Capsule Board may introduce identity verification, transaction monitoring, or compliance measures in the future. Regulatory Changes: Features may be modified to comply with evolving laws and regulations.
13. Amendments and Termination
Modifications: Capsule Board may update these terms at any time. Continued use constitutes acceptance. Termination: Capsule Board may suspend or terminate accounts for violations or risk mitigation.
